The following terms carry specific meanings throughout this document:

  • "Firm", "We", "Us", or "Our" — Bicara Keluarga, a family law practice registered in Malaysia, with offices at 38, Jalan Bukit Bintang, 55100 Kuala Lumpur.
  • "Client" or "You" — any individual who accesses this website, submits an inquiry, or engages the Firm for legal services.
  • "Services" — the family law advisory and representation services offered by the Firm, including marital mediation, divorce proceedings, and child custody matters.
  • "Website" — all pages hosted under the domain bicarake.club.
  • "Agreement" — these Terms & Conditions, together with any engagement letter or fee agreement executed between the Client and the Firm.
  • "Content" — all text, documents, images, forms, and other material appearing on the Website.

2. Acceptance of Terms

By using the Website or submitting an inquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter a binding agreement under Malaysian law. If you are acting on behalf of another person, you represent that you have authority to bind that person to this Agreement.

Use of the Website does not by itself create a solicitor-client relationship. Such a relationship arises only when the Firm has accepted your matter in writing and an engagement letter has been signed by both parties.

3. Service Description

Bicara Keluarga offers family law services to individuals in Malaysia, with a focus on civil marriages and proceedings under Malaysian family law. The three principal service areas are:

  • Marital Mediation & Reconciliation Counsel — structured facilitated sessions aimed at resolving disputes without initiating divorce proceedings.
  • Divorce Proceedings & Property Division — representation and advice throughout civil divorce proceedings, including asset division and maintenance matters.
  • Child Custody & Welfare Arrangements — advice and representation on custody, access schedules, and welfare applications, including cross-border matters where applicable.

Services are provided from the Kuala Lumpur office. Remote consultations may be arranged at the Firm's discretion. Services are conducted in English or Bahasa Malaysia as agreed with the Client.

4. User Responsibilities

When using the Website or engaging the Firm's services, you agree to:

  • Provide accurate, complete, and current information at all times.
  • Notify the Firm promptly of any changes to information you have provided.
  • Use the Website only for lawful purposes and in accordance with these terms.
  • Not use the Website to transmit unsolicited communications, spread misinformation, or interfere with its operation.
  • Not attempt to gain unauthorised access to any part of the Website or its underlying systems.
  • Treat Firm staff and representatives with respect throughout all communications.

Failure to meet these responsibilities may result in the Firm declining to accept or continuing your matter.

5. Intellectual Property

All Content on this Website — including text, layout, images, and design — is the intellectual property of Bicara Keluarga or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and view the Website for personal, non-commercial purposes only.

Any documents or written summaries prepared by the Firm for your matter remain the Firm's intellectual property until fees have been paid in full, at which point you receive a licence to use those documents for the purposes for which they were prepared.

6. Payment Terms

Our published service fees are as follows:

  • Marital Mediation & Reconciliation Counsel — MYR 750
  • Divorce Proceedings & Property Division — from MYR 1,210
  • Child Custody & Welfare Arrangements — from MYR 1,490

Fees are quoted in Malaysian Ringgit (MYR) inclusive of applicable taxes unless stated otherwise. The published fees represent our standard starting rates; the Firm will confirm the applicable fee in writing before work commences. Complex matters or matters requiring court appearances may attract additional fees, which will be communicated transparently.

Payment is accepted by bank transfer. A deposit may be required before work begins. The Firm does not offer refunds on work already completed, though we endeavour to address any concerns about our service promptly and fairly.

7. Service-Specific Terms

Mediation Services

Mediation sessions are typically four to six in number, spread over approximately two months. Session scheduling is agreed with both parties in advance. The Firm maintains strict neutrality and does not advocate for either party. Written summaries of agreed points are prepared after each session.

Divorce Proceedings

Representation covers civil divorce proceedings only. The Firm will conduct an intake conversation before accepting a matter. Court timelines are subject to the courts' schedules and are outside the Firm's control. The Firm will communicate regularly on progress in plain language.

Child Custody

All advice and representation is guided by the welfare of the child as the paramount consideration. The Firm may recommend involvement of independent welfare assessors where appropriate. Cross-border matters involving foreign jurisdictions are handled in collaboration with corresponding advisers as needed.

Confidentiality

All information shared with the Firm is treated as strictly confidential and protected by professional legal privilege. We do not disclose client information to third parties except where required by law or with your written consent.

8. Disclaimers

Content on this Website is provided for general informational purposes and does not constitute legal advice. Reading this Website does not create a solicitor-client relationship. 9. Limitation of Liability

To the fullest extent permitted by Malaysian law, the Firm's liability for any claim arising from these terms or from the services provided shall not exceed the total fees paid by the Client for the specific service giving rise to the claim.

The Firm shall not be liable for indirect, incidental, or consequential losses, including loss of income, loss of opportunity, or emotional distress, except where such liability cannot be excluded by law.

Nothing in these terms excludes liability for fraud, gross negligence, or any liability that cannot lawfully be limited.

10. Indemnification

You agree to indemnify the Firm, its advisers, and staff against any claims, losses, or expenses arising from your breach of these terms, your misuse of the Website, or your provision of inaccurate information in connection with a matter handled by the Firm.

11. Termination

Either party may terminate an engagement by providing written notice. The Firm may decline to continue or accept a matter if a conflict of interest arises, if instructions become unclear or unethical, or if fees remain unpaid after a reasonable period.

On termination, the Client remains responsible for fees for work completed to that point. Sections covering intellectual property, confidentiality, disclaimers, liability, and dispute resolution survive termination.

12. Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising under or in connection with these terms shall first be addressed through good-faith discussion between the parties.

If a dispute cannot be resolved informally within thirty (30) days, the parties agree to submit to mediation administered by the Malaysian Bar Council or a mutually agreed mediator before initiating court proceedings. The courts of Kuala Lumpur shall have exclusive jurisdiction over any dispute not resolved through mediation.

13. General Provisions

  • Entire Agreement: These terms, together with any engagement letter, constitute the entire agreement between the parties.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
  • Waiver: Failure by either party to enforce a provision does not constitute a waiver of the right to enforce it later.
  • Assignment: You may not assign your rights under these terms without the Firm's written consent. The Firm may assign obligations in connection with a merger or restructure.
  • Notices: Formal notices should be sent by email to [email protected] or by post to the address below.

14. Changes to These Terms

The Firm may update these terms from time to time. Changes take effect when the revised version is published on this page with an updated "Last Updated" date. Continued use of the Website or services after changes are posted constitutes acceptance of the revised terms.

For matters already under engagement, material changes to terms will be communicated directly to the relevant client.
